
A year of "in futurum" measures
Article 145 of the French civil procedure code: Octave Hocher analyzes the case law on investigative measures "in futurum" in his 2024 column published in the journal Procédures.
When a party considers that it lacks evidence to win its case and wishes to ask the judge for an investigative measure to help him recover this evidence (an expertise, a bailiff's report, etc.), he must use article 145 of the French civil procedure code relating to investigative measures "in futurum". This article is the basis for "in futurum" investigative measures, which represent a major part of business litigation in France.
