A year of "in futurum" measures

When a party considers that it lacks evidence to win its case and wishes to ask the judge for an investigative measure to help him recover this evidence (an expertise, a bailiff's report, etc.), he must use article 145 of the French civil procedure code relating to investigative measures "in futurum". This article is the basis for "in futurum" investigative measures, which represent a major part of business litigation in France. Each year, Octave Hocher publishes a column of case law on the subject in the journal Procédures (Editions LexisNexis). The chronicle of the year 2024 can be found in issue no. 12 of December 2024.
